For questions about data protection and to exercise your rights, please contact this address. No data protection officer has been appointed, as the legal requirements for this are not met.
This website and the management software behind it are operated for us by SES Software Entwicklung Sieg, owner Sandra Sieg, Röhnweg 5, 01159 Dresden, Germany, on its own servers in Germany. SES acts on our instructions under a data processing agreement pursuant to Art. 28 GDPR.
Each time a page is requested, the server automatically stores log data: the IP address of the requesting system, date and time, the requested address, the HTTP status code and the amount of data transferred, the previously visited page (referrer) if your browser sends it, and browser type and operating system. This data serves to deliver the page, to keep it secure and to fend off attacks; we do not combine it with other data. Log files are deleted after seven days at the latest, unless a specific security incident requires longer retention until it has been resolved.
To protect forms against mass abuse, the server limits the number of submissions per IP address; for this purpose the address is only held in memory for one minute and is not stored.
The legal basis is Art. 6 (1) (f) GDPR; our legitimate interest lies in the secure and trouble-free operation of the website.
This website only uses its own cookies, and only those required for a function you trigger. No cookie is set when you merely open a page. Each of the following cookies is only created by an action of yours:
If you tick “Remember my contact details” in the enquiry form, your browser keeps your contact details in its local storage so that the form is filled in next time. These details do not leave your device; untick the box to delete them.
Storing the cookies listed is strictly necessary for the service you requested (Section 25 (2) no. 2 TDDDG); remembering your contact details is based on your consent given by ticking the box (Section 25 (1) TDDDG). A consent banner is therefore not required. Via apartments-dresden.de/revoke-consent you delete the watch list, comparison and map approval cookies in one step. You can also delete or block cookies and site data in your browser at any time; reading and searching remain fully possible.
Search terms and filters are transmitted to our server as part of the requested address and evaluated there; they are not stored beyond the log data described in section 2. Please do not enter personal data in the search field. The legal basis is Art. 6 (1) (f) GDPR.
For each flat you can send us an enquiry using the “Contact the provider” form. We process your salutation, first and last name and e-mail address (mandatory) and, voluntarily, your phone number, address, message and a viewing request. We also store which flat the enquiry refers to.
Confirmation code: To prevent abuse, we send a six-digit code to the e-mail address given before the form is submitted. The code is valid for ten minutes and is only held in memory for that time.
Processing of the enquiry: Your enquiry is stored in our customer management and forwarded by e-mail to the contact person responsible for the flat; on request you receive a copy. The receipt of an enquiry is recorded with your e-mail address in the application server log so that abuse can be traced; this log is deleted after [placeholder: retention period of application server logs].
The purpose is to answer your enquiry and, where applicable, to prepare a tenancy. The legal basis is Art. 6 (1) (b) GDPR (pre-contractual measures); for the confirmation code and logging, Art. 6 (1) (f) GDPR with our legitimate interest in preventing abuse.
Retention: enquiries that do not lead to a tenancy are deleted after [placeholder: period for enquiries without a tenancy]. If a tenancy agreement is concluded, we keep the data for the duration of the tenancy and afterwards within the statutory retention periods.
If you e-mail or call us, we process your details solely to handle your request. The legal basis is Art. 6 (1) (b) GDPR for enquiries about renting, otherwise Art. 6 (1) (f) GDPR. We delete the details once your request has been dealt with and no statutory retention periods apply.
To show the location of our flats and directions we display maps based on OpenStreetMap. The map material is provided by the OpenStreetMap Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom.
The map is not loaded automatically. You first see a placeholder; only when you click “Load map” are map tiles retrieved from the servers of the OpenStreetMap Foundation. Your IP address and technical browser data are transmitted in the process. We remember your decision in the cookie described in section 3 until you close your browser.
The legal basis is your consent pursuant to Art. 6 (1) (a) GDPR in conjunction with Section 25 (1) TDDDG. You can withdraw it at any time via apartments-dresden.de/revoke-consent. An adequacy decision of the European Commission exists for the United Kingdom. More information: osmfoundation.org/wiki/Privacy_Policy.
For some flats we show videos hosted on YouTube. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. We embed the videos in privacy-enhanced mode via youtube-nocookie.com. No connection to YouTube is made when a page is opened; only when you click a video does YouTube receive your IP address and the information which page you visited, and information may be stored on your device. If you are signed in to Google at that time, Google may assign the request to your account.
The legal basis is your consent pursuant to Art. 6 (1) (a) GDPR in conjunction with Section 25 (1) TDDDG, which you give by starting the video. A transfer to the USA cannot be ruled out; Google is certified under the EU-US Data Privacy Framework. Details: policies.google.com/privacy.
If we link to third-party websites, data is only transmitted to their operators when you click the link. From then on their privacy policy applies.
Within our business, only the persons handling your enquiry receive your data. As processors pursuant to Art. 28 GDPR we use SES Software Entwicklung Sieg for hosting and operation (section 2) and [placeholder: e-mail provider with name and registered office] for sending e-mails. You trigger the requests to OpenStreetMap (section 7) and YouTube (section 8) yourself. Beyond that we only pass on data if we are legally obliged to do so. We do not sell data.
We only store personal data for as long as necessary for the respective purpose. The periods for log data, enquiries and cookies are stated in sections 2, 3 and 5. Where data is subject to a statutory retention obligation, for example under Section 147 AO or Section 257 HGB with periods of six or ten years, we keep it until the period expires and delete it afterwards.
You have the right of access to your data stored by us (Art. 15 GDPR), to rectification (Art. 16), to erasure (Art. 17), to restriction of processing (Art. 18) and to data portability (Art. 20). You can withdraw consent at any time with effect for the future (Art. 7 (3) GDPR); the lawfulness of processing carried out until then remains unaffected. An informal message to the address in section 1 is sufficient.
Right to object pursuant to Art. 21 GDPR: Where we process your data on the basis of Art. 6 (1) (f) GDPR, you may object at any time on grounds relating to your particular situation. We will then no longer process the data unless we can demonstrate compelling legitimate grounds that override your interests, or the processing serves the establishment, exercise or defence of legal claims.
Right to lodge a complaint: You may lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the Saxon Data Protection and Transparency Commissioner (Sächsische Datenschutz- und Transparenzbeauftragte), Devrientstraße 5, 01067 Dresden, Germany.
You are not obliged to provide us with personal data. Without your name and e-mail address, however, we cannot answer an enquiry submitted via the form. No automated decision-making, including profiling, within the meaning of Art. 22 GDPR takes place.
We update this privacy notice when the functions of this website or the legal framework change. The version available here applies.
